Terms of Service

These Terms of Service ("Terms") govern your use of SendPigeon's transactional email API and related services ("Service") operated by SendPigeon ("we", "us", or "our"). By accessing or using the Service, you agree to these Terms. If you do not agree, you may not use the Service.

1. Definitions

  • Service: SendPigeon's API, dashboard, and related features for sending transactional emails.
  • User Content: Emails, templates, recipient data, or any material you submit or send using the Service.
  • Account: Your registered SendPigeon account, including credentials and API keys.

2. Account Registration

To use the Service, you must:

  • Provide accurate information during registration.
  • Be at least 18 years old or have legal capacity to enter these Terms.
  • Keep your account credentials and API keys secure.
  • Notify us immediately of any unauthorized access.

You are responsible for all activities under your account.

3. Acceptable Use

You may only use the Service for lawful purposes. You may not:

  • Send spam, unsolicited bulk emails, or messages to recipients without explicit consent.
  • Send phishing emails or impersonate others.
  • Distribute malware or harmful attachments.
  • Send illegal, violent, or hate-promoting content.
  • Violate intellectual property rights.
  • Harass, threaten, or intimidate recipients.

We may suspend or terminate accounts for violations, without prior notice.

4. Email Compliance

You are responsible for following all applicable email laws, including:

  • CAN-SPAM Act (U.S.)
  • GDPR (EU)
  • CASL (Canada)
  • Any other local anti-spam laws

This includes obtaining consent, honoring unsubscribe requests, and including required information in your emails.

5. Domain Verification

To send emails, you must verify ownership of sending domains. You agree to:

  • Only verify domains you own or control.
  • Maintain correct DNS records.
  • Not spoof or impersonate other domains.

6. Payments

Certain features require a paid subscription. By subscribing:

  • You authorize recurring charges to your payment method.
  • Fees are non-refundable unless required by law or stated otherwise.
  • Pricing changes will be notified 30 days in advance; continued use constitutes acceptance.
  • You are responsible for applicable taxes.

7. Service Availability

We strive for high availability but do not guarantee uninterrupted service. The Service is provided "as is". We are not liable for:

  • Temporary downtime or service interruptions.
  • Delays or failures in email delivery.
  • Data loss, corruption, or third-party service outages.

8. Security

You agree to:

  • Protect account credentials and API keys.
  • Refrain from attempting to bypass security features.
  • Immediately report security breaches.

9. Data and Privacy

Your use is governed by our Privacy Policy. By using the Service, you consent to the collection, storage, and use of data as described therein.

10. Intellectual Property

  • SendPigeon owns the Service, including code, design, and documentation.
  • You retain ownership of your User Content.
  • You grant SendPigeon a limited license to process your content solely to provide the Service.

11. Limitation of Liability

To the maximum extent permitted by law, SendPigeon is not liable for:

  • Indirect, incidental, special, or consequential damages.
  • Loss of profits, revenue, data, or reputation.
  • Costs of substitute services.

Our total liability is limited to the amount you paid in the 12 months preceding a claim.

12. Indemnification

You agree to indemnify and hold harmless SendPigeon and its affiliates from any claims, damages, or expenses arising from:

  • Your use of the Service.
  • Violation of these Terms.
  • Violation of third-party rights.
  • Content sent through the Service.

13. Termination

  • We may suspend or terminate your account for violations of these Terms.
  • You may cancel your account at any time.
  • Upon termination, your right to use the Service ends immediately.
  • Data may be deleted after 30 days, unless otherwise required.
  • Surviving provisions (e.g., liability, indemnification) remain in effect.

14. Changes to Terms

We may modify these Terms. Material changes will be notified via email or the Service. Continued use after changes constitutes acceptance.

15. Governing Law

These Terms are governed by the laws of Sweden, without regard to conflict-of-law principles. Any disputes will be resolved in the courts of Sweden.
